Should this site be punished?

Every summer for the past 4 years one of our customer's competitors suddenly has a big jump in Google's (.co.uk) rankings for some of the main industry phrases, particularly "air conditioning".
We were always under the impression that they bought links before the busy summer season, as they have these strange massive jumps in the rankings. (for the rest of the year they often drop down) I recently checked out some of the back-links going to their site and noticed something I'd not seen before. Of the (approx) 480 links that showed up, around 80% of the SourceURL's ended with "?Action=Webring" (see 1st attached image).
To me it doesn't look natural at all and I'm surprised that Google hasn't picked up on. Their site is www.aircon247.com. It had been mentioned to me that this may be to do with link sharing sites (which I assume is black-hat) but I'm not 100% sure that they are doing this.
They also have an identical long spammy-looking footer at the bottom of every page which is clearly only for search engines to see. We reported it to Google a year ago but no action was taken. Do you think that it is acceptable to have it on every page? (see 2nd attached image)
I would be interested to know your thoughts on both of these, and whether this would be a dangerous tactic to try and emulate?

Yes they "should" be punished. But they probably won't, at least not for a long time. To Google's own detriment they don't act on spam reports nearly enough, which results in spam working more than it should, which results in more spam... and frustrated competition who were playing fair deciding "If you can't beat them, join them". The all the combined intelligence over at Google you'd think they'd figure out that for long term benefits it's best to act on the spam reports instead of just gathering data from them.

My personal view, although I'm sure some will disagree and stamp on my toes, is that complaining about competitor tactics is a waste of time. The chances of Google adding a manual penalty based on your report is very, very slim so your time is better spent working out ways to beat them the right way.
Looking at their backlink profile, there are a huge amount of paid links, general directories and not really much else. With that in mind I'd say that although they have a decent amount of linking domains it should be possible to beat them without using the same tactics.
Another thing to remember is that even if you did go down the route of trying to copy their method you wouldn't be guaranteed to succeed so might waste a load of time and money with nothing to show but a penalty.
As for the spammy footer... it might be adding some benefit to their site but I doubt it's having a huge impact... and it just looks horrid!

Being a coupon website, my content is always keeps changing (as new coupons are added and expired deals are removed) automatically. I wish to create a sitemap but I realised that there is not much point in creating a sitemap for all pages as they will be removed sooner or later and/or are canonical. HELP - Site architecture of E-Commerce Mega Menu - Linkjuice flow
Hi everyone, I hope you have a couple of mins to give me your opinion. Ecommerce site has around 2000 products, in english and spanish, and around only 70 hits per day if that. We have done a lot of optimisation on the site - Page Titles, URL's, Content, H1's, etc.... Everything on page is pretty much under control, except I am starting to realise the site architecture could be harming our SEO efforts. Once someone arrives on site they are language detected and do a 302 to either domain.com/EN or domain.com/ES depending on their preferred language. Then on the homepage, we have the big MEGA MENU - and we have

SubsubCat 3 Overall, there are 145 "categories". Plus links to some CMS pages, like Home, Delivery terms, etc... Each Main Category, contains the products of everything related to that category - so for example:

FRYING PANS Kitchenware contains: ALL PRODUCTS OF SUBCATS BELOW, SO COOKWARE ITEMS, SAUCEPANS, FRYING PANS, BAKINGWARE, etc... plus links to those categories through breadcrumbs and a left hand nav in addition to the mega menu above. So once the bots hit the site, immediately they have this structure to deal with. Here is what stats look like:

I really need some other opinions here - I am thinking of: Removing links in Nav menu so it only contains CAT1 and SUBCAT1 but DELETE SUBSUBCATS1 which represent around 80 links Remove products within the CAT1 page - eg., the CAT 1 would "tile" graphical links to subcategories, but not display products themselves. So products are only available right at the lowest part of the chain (which will be shortened) But I am willing to hear any other ideas please - maybe another alternative is to start building links to boost DA and linkjuice? Switching site content
I have been advised to take a particular path with my domain, to me it seems "black hat" but ill ask the experts: Is it acceptable when one owns an exact match location domain eg london.com, to run as a tourist information site, gathering links from wikipedia,bbc,local paper/radio/sports websites etc, then after 6 - 12 months, switch the content to a business site? What could the penalties be? Please advise...

Is my competitor up to no good? Strange site-explorer results.
I'm researching a competitor using site explorer and the seomoz toolbar and getting some strange results. When you search by the domain name in site explorer you get no results, but the toolbar shows 170K incoming links. http://www.opensiteexplorer.org/links?site=www.augustagreenlawns.com I noticed the top referring page was a strange internal url so I ran that through site explorer and discovered 19 links.. When you put the strange link in a browser, it redirects to the home url;.. At this url the toolbar shows 220 links and semoz shows 19 http://www.augustagreenlawns.com/?xid_78e7f=0f2a64344c8de6bdf2d8cdf8de93ea5c http://www.opensiteexplorer.org/links?site=www.augustagreenlawns.com%2F%3Fxid_78e7f%3D0f2a64344c8de6bdf2d8cdf8de93ea5c What is up with that url? Does 301 redirection will effect my site in the future?
Hello Guys, I am totally new to SEOMOZ.com, when I had issues with my website I asked one of my friend who does SEO he suggested me to implemented 301 redirection approximately 11 months a go, here is the URL of the website http://www.bharatdesi.com/hyderabad . Will Google ban my website from search engine results, what would be the worst scenarios. know there are really good SEO people who follow SEOMOZ everyday... Can any one here please suggest me with some good answers weather I have to remove 301 redirection or I can still keep the same until my home page gets redesigned. I don't really understand all the concepts of SEO, but if some one can help me with the good answers I can ask my developer to the same. Thank you

Has Panda help this site achieve great heights? How? and Why?
Today I went about my business in trying to understand what is happening in our market, eyewear, after the last Panda update. I was interested to know if any of our competitors were effected as much as we were for a very competitive key phrase To my surprise a new kid appeared on the block, well, on page one, position two. Imagine my second surprise, when the new kid turn out to be a 3 month old domain, yes 3 months, with zero page rank and zero back links. I was in for one more surprise before I stood up, walked to the window and gazed into space to contenplate the meaning of Panda and SEO as we know it. This third surprise was the site in question is a counterfeiting site using black hat SEO with fast results. Client Selling Links On One Site Hurt Their Other Site?
Hi, I have a client who is thinking about selling ads on one site they own via something like textlinkads.com. Do you think they run any risk of exposing their other sites to scrutiny, penalties or problems?

Is this site penalized?
So I am working on a potential new client and they run several very well established and well ranking ecommerce sites. They have 1 site which is new and underperforming which they want me to "start" on as a trial. The idea being that if they like the progress I would take over SEO on the other sites. After a little research I am concerned that this site may be have a penalty. The site is www.discoverhookah.com The MOZrank and MOZtrust are actually pretty good considering the site is 6 months old, but if you look at the links they are ALL junk. They seems to be some reciprocal linking as well. I believe this is something they have done on their other sites and been ok with because they are 10+ years old and very trusted, however for a new site this link profile worries me. I do not have their analytics yet but looking at their traffic in compete.com shows a HUGE drop off shortly after the site went up (like from 2500 to under 100 visitors). I dont really trust compete.com's numbers outside of being and good indicator for trends, but it has me concerned. The client did tell me they are getting virtually no traffic. I am waiting on the crawl report to confirm its not a crawl or onsite problem but i dont think it is. I have 2 concerns: 1. I am taking this site on the cheap in order to establish a successful project, so I can work on their other sites, and I dont want to walk into a losing situation on the cheap! 2. I believe their webmaster is following some misguided SEO strategies but she has been with them for a long time. I dont think she wants to do theor SEO anyway, as she is very busy with maintenance and development, but if I could prove a penalty it would go a long way in helping me win the whole account from an SEO standpoint.
