Moving website and domain name without 301 Redirect or rel=canonical

I do not wish to draw attention to my company, so I am using code names. For the sake of this discussion, we are a new car dealership representing Brand X Cars. The manufacturer of Brand X Cars pushes its dealers toward a website hosting company called CarWebsites in order to maintain a level of quality and control with each dealer. However, we have found the platform to be too restricting, and are switching to our own WordPress site.
Unfortunately Brand X is claiming ownership of our original domain, BrandXCarDealer.net, so we have switched to BrandXCarDealer.com (which we prefer anyways). Now both websites are running, and there is duplicate content of everything. Brand X is not cooperative and will not 301 redirect to the new site, and we do not have access to the of the website for a rel=canonical. Brand X is also dragging its feet on shutting down BrandXCarDealer.net. We do still have access to change the content of the pages on the BrandXCarDealer.net site, but that is pretty much as far as our control goes.
So my question is, is there anything we can do, without using a 301 redirect or rel=canonical, to tell Google to pay attention to the new BrandXCarDealer.com rather than the old BrandXCarDealer.net? Any suggestions are appreciated. Thanks!

Thanks, this is all great advice! I'll have to look into the CarWebsites Terms of Use to see if we have a leg to stand on when it comes to domain and content ownership.
The local listings and most other links around the web are already pointing to the new site, so that is a good thing.
That is very interesting about the .CARS extension. I have always wondered if that would have an impact... I might try that when I get some time down the road.
I have also been considering going to each landing page on the old BrandXCarDealer.net site, erase all the content, and replace it with, "This page has been moved to BrandXCarDealer.com/landing-page-1"
Any thoughts?

Sherry, unfortunately, without having a 301 redirect in place, there's not much you can do to directly tell Google that the site has been moved. In order to use their Google Change of Address Tool, you have to set up the 301 permanent redirect from the old URL to the new URL (old domain to new domain). If you can get access, that's what you really need to do.
If the old site won't be taken down, there are a few things you can do, like send them a stern letter or let the lawyers get involved. Typically a letter from a lawyer will get their attention. You can, also, file a DMCA request with their web host, which they must comply with, telling the web host that the material on the old site is copyrighted (you own the copyright and rights to it) and it must be taken down.
If they won't give you the domain name, then you can file a UDRP domain dispute with ICANN to try to get ahold of the domain name. That will take some time, though. But in the long run you'll get ahold of the domain and be able to redirect it.
In the meantime, while you're dealing with all of this, you can begin to get all of your local listings (like Google My Business, etc.) and local citations moved over to point to your new site rather than the old site. In fact, you can start building links to the new domain name and Google will, hopefully, start ranking your new domain name higher in the search results.
Finally, you might actually consider moving the site to a .CARS domain extension, we've seen some really great success from dealerships that have moved from a .COM to a .CARS domain.

New Domain Name or Keep going - Help not Recovering after Penguin
Hi Moz Friends I wonder if you can help me , a while ago we had a Penguin Penalty and lost our Rankings. After Months of work Disavow and Reconsiderations , Google sent me a message in Webmaster Tools to confirm the Penalty had been uplifted. Since then we havent recovered. I have been working with Bloggers to build relevant safe links, each having a DA of between 10-30. We have developed a Mobile Friendly Website and ios and Android Apps. We have improved Site Speed and moved to a Server within the same Country. We add lots of content and believe we have ticked all the boxes for onpage optimisation. However our DA and PA seems to have dropped slightly after Moz update today. We seem to be jumping in the serps, one day page 4 for "fancy dress" the next day nowhere to be found. I'm not sure what to do next. I'm not expecting to jump back to page 1 for the main keywords but some positive movement would be nice, especially as there are Lower DA Website, not mobile friendly or as fast above us in the serps. What I am looking for I guess is any ideas from you and also what you think about this idea A few people have mentioned that we might stand more of a chance using our domain name example.com instead of example.co.uk. example.com has never been used and is totaly clean (no penaltys ect..) Do we use example.com and move the website and content away from example.co.uk ? if so do we use redirects or would that just pass any hold thats on example.co.uk to the .com version Ideas Welcome Thanks Adam

Is horizontal hashtag linking between 4 different information text pages with a canonical tag to the URL with no hashtag, a White Hat SEO practice?
Hey guys, I need help. hope it is a simple question : if I have horizontal 4 text pages which you move between through hashtag links, while staying on the same page in user experience, can I canonical tag the URL free of hashtags as the canonical page URL ? is this white hat acceptable practice? and will this help "Adding the Value", search queries, and therefore rank power to the canonical URL in this case? hoping for your answers. Removing/ Redirecting bad URL's from main domain
Our users create content for which we host on a seperate URL for a web version. Originally this was hosted on our main domain. This was causing problems because Google was seeing all these different types of content on our main domain. The page content was all over the place and (we think) may have harmed our main domain reputation. About a month ago, we added a robots.txt to block those URL's in that particular folder, so that Google doesn't crawl those pages and ignores it in the SERP. We now went a step further and are now redirecting (301 redirect) all those user created URL's to a totally brand new domain (not affiliated with our brand or main domain). This should have been done from the beginning, but it wasn't. Any suggestions on how can we remove all those original URL's and make Google see them as not affiliated with main domain?? or should we just give it the good ol' time recipe for it to fix itself??

Cross-Site Links with different Country Code Domains
I have a question with the penguin update. I know they are really cracking down on "spam" links. I know that they are wanting you to shift from linking keywords to the brand name, unless it makes sense in a sentence. We have five sites for one company in the header they have little flag images, that link to different country domains. These domains all have relatively the same domain name besides the country code. My question is, linking these sites back and fourth to each other in this way, does it hurt you in penguin? I know they are wanting you to push your identity but does this cross-site scheme hurt you? In the header of these sites we have something like this. I am assuming the best strategy would probably be to treat them like separate entities. Or, just focus on one domain. They also have some sites that have links in the footer but they are set up like:

Penalty for all new sites on a domain?
Hi @all, a friend has an interesting problem. He got a manuel link penalty in the end of 2011...it is an old domain with domainpop >5000 but with a lot bad links (wigdet and banners and other seo domains, but nothing like scrapebox etc)...he lost most of the traffic a few days after the notification in WMT (unnatural links) and an other time after the first pinguin update in april´12. In the end of 2012 after deleting (or nofollowing) and disavow a lot of links google lifted the manuel penalty (WMT notification). But nothing happened after lifting, the rankings didn´t improve (after 4 months already!). Almost all money keywords aren´t in the top 100, no traffic increases and he has good content on this domain. We built a hand of new trust links to test some sites but nothing improved. We did in february a test and build a completely new site on this domain, it´s in the menu and got some internal links from content...We did it, because some sites which weren´t optimized before the penalty (no external backlinks) are still ranking on the first google site for small keywords. After a few days the new site started to rank with our keyword between 40-45. That was ok and as we expected. This site was ranking constantly there for almost 6 weeks and now its gone since ten days. We didn´t change anything. It´s the same phenomena like the old sites on this domain...the site doesnt even rank for the title! Could it still be an manuel penalty for the hole domain or what kind of reasons are possible? What's the best way to set up 301's from an old off-site subdomain to a new off-site subdomain?
We are moving our Online store to a new service and we need to create 301's for all of the old product URLs. Being that the old store was hosted off-site, what is the best way to handle the 301 re-directs? Thanks!

Huge diifference linking root domains in SEO MOZ and opensite explorer
Hi there, I have fairly large site that has never really been optimised. I think an old forum i hosted has either been spammed or my webmaster at the time used some black hat techniques to get me more root linking domains. I am a newbie and would really appreciate if someone could just quickly look at my donain and confirm that this is a problem and something i should fix before i start my SEO campaign. I am also worried this will negatively effect my domain authority. I dont really want to broadcast my domain so if anyoone would be so kind to confirm the problem so i cant start to research the answer. Thanks v much
