Hi can anyone help me. I am trying to track information from sites. I am at the moment got solicitiors involved ref trade mark of a name and we are trying to prove that this name was being used before the trade mark application.
A company has gone ahead with a trade mark in full knowledge that this is a common name and we have been told if we can prove that the name was being used before it was registered then we can knock out the trade mark.
We have been told there is an internet archive but i cannot find one, can anyone please let me know how i can look at sites from before 2010 and see about if they were using this word to help our case.

Thanks for that. This guy is very slippery and it is bad news that he is allowed to get away with stuff. Our legal team have said that because we have no proper proof of him attacking our site although they and we know what he is doing, we cannot take him to court. We are trying to see if we can take him to court for false alligations to our hosting company because he gave his name to them. But with other companies he has been using different names.
This is costing us thousands of pounds and it seems we are getting no nearer to stopping him or sorting it out.
We had to change the content on our site because he was copying it and then passing it on as his own and sending it to people who have sites that represent him, so our rankings dropped and while the legal team were sorting it out we took the choice to re write a lot of the content.
There needs to be more guidelines in place to stop all this, but there is some good news as the guy who is trying to off load franchises is getting a bad reputation.
We got into a forum that is just meant for his franchisee people and we got in by just registering and found he was calling our company and making recommendations on how to stop us from getting customers and when our legal team made him aware of this, he went mad and said it was wrong of us to be on his forum and he quickly put a lock on it.

If you can imagine Diane, it gets worse.
I have a client who has offered multiple brands for many years, dating back as far as 2002. A distributor whom she sold products to noticed two of the brands were not properly trademarked. The distributor successfully trademarked one brand, and was months into the application process of the second brand when the issue was discovered.
This distributor actually filed a trademark infringement complaint with Google and removed all of my client's advertisements, and then filed a trademark complaint with her host forcing her to remove the products from her store. Once a trademark is actually granted, the process is much harder to address.
To deal with the granted trademark, a formal process called a Cancellation had to be filed. I completed the paperwork and have confidence my client will win eventually, but this distributor actually hired an attorney and clearly intends to drag out the process as long as possible. This entire time he has the benefit of owning the trademark which prevents anyone else from selling or advertising the product. Imagine a product sold by dozens of distributors now only being sold by a single entity. Once the issue is resolved, legal action can be pursued against him, but clearly the type of person to take this action is very shady.
The second trademark was caught in time to where an Opposition notice was filed.
In order to receive the trademark, the applicant had to sign under penalty of perjury a document stating he is the mark's owner and has no knowledge of it's use in commerce by others. Clearly signing that statement was fraudulent and it can be used in a lawsuit, but this is a long process spanning years and should be avoided.
My strongest advice is to always register any marks used in your business, and to monitor the Register where new trademark applications are posted. You need to watch not only for exact matches, but marks which look or sound similar to a mark you own.

Hi thanks for that and thank you egol for the website address. It seems a company who has registered this trade mark done so in the full knowledge that it was imoral. It is wrong that the trade mark office is not more widely out there, what i mean is, anyone can secretly register a trade mark in the UK and it seems it is hard to have it stopped.
We have a company who we did not class as our compeditiors as they were not in the same class as us, but because we were getting all the customers coming to us, they were not happy about this and started doing things that were not nice, like trying to reduce traffic to one of our sites, making false aligations, trying to have articles removed from sites, basically i am sure they have a horse in their back garden.
We have now a legal team in place to sort this out, but we have been told that we have to show companies have been using the trade mark name before they registered it, and then it can be dropped. So we are hoping to find these companies and hoping like us that they have been using that name for some time.
It seems terrible that a company can be allowed to do what they have been doing such as attacking our site and trying to cause dead links.

I would add that trademark law is a complex field. The specific detail which is the deciding factor for a case with an unregistered trademark is "first use in commerce". The use of a term in and of itself is not significant unless there is a clear commercial intent.
The above information is specific to the United States; however, there seems to be a lot of similarity with trademark laws throughout the world.

Href lang issues - help needed!
Hi, I have an issue with Google indexing the US version of our website rather than the UK version on Google.co.uk. I have added hreflang tags to both sites (https://www.pacapod.com/ and https://us.pacapod.com/), have updated and submitted an XML sitemap for each website and checked that the country targeting in search console is set-up correctly but Google are still indexing the wrong website. Help with site structure needed - any assistance welcomed!
Hi all, I am currently tasked with finding a better way to optimise our website ukdocumentstorage dot com. For starters, I would like to know what our site structure actually is at present. So I would like to be able to see which pages are linking to what at the moment & which pages have broken links on which I need to remove from the content. Hopefully I'd then be able to tidy up any errors that the site already has in its internal linking. Is there a way to do this easily? Or to have a graphical representation of the sites structure? I have just signed into our Webmaster Tools account and I am faced with a list of 10 'Crawl Errors' which are all 404 errors. Some of them do not actually exist anymore, but are still being linked to from a few pages according to WMT. For example, /industries_served_legal.htm is still being linked to from 5 of our pages (including /industries_served_local_authority.htm) However, this doesn't seem to be a case at all on the page as I can't find a link to /industries_served_legal.htm on /industries_served_local_authority.htm. Any advice as to why this is happening? Is there a way to find out easily where these broken links are situated on the page? And if I do actually manage to find our broken links, how would I go about removing them? The page /document_security.htm doesn't exist in our Sitewizard list of pages anymore, yet still exists online. How do I go about deleting this unecessary page properly? And does this harm our rankings? The document_security page also has an extra link on the top toolbar to a Document Management page, an addition which is no longer present on our up to date pages. Now this page (and the extra dropdown page when you hover over it) still exist on our list of Sitewizard pages at the moment, but we obviously no longer want to have these online anymore. How should I remove these? I understand that this is a lot of information, and so I would appreciate any help that can be given on these! Many thanks

Client's site dropped completely for all keywords, but not brand name - not manual penalty... help!
We just picked up a new search client a few weeks ago. They've been a customer (we're an automotive dealer website provider) since October of 2011. Their content was very generic (came from the previous provider), so we did a quick once-over as soon as he signed up. Beefed up his page content, made it more unique and relevant... tweaked title tags... wrote meta descriptions (he had none). In just over a week, he went from ranking on page 4 or 5 for his terms to ranking on page 2 or 3. My team was working on getting his social media set up, set up his blog, started competitor research... And then this last weekend, something happened and he dropped completely from the rankings... He still shows up if you do a site: search, or if you search his exact business name, but for everything else, he's nowhere to be found. His URL is www.ohioautowarehouse.com, business name is "Ohio Auto Warehouse" We filed a reconsideration request on Monday, and just got a reply today that there was no manual penalty. They suggested we check our content, but we know we didn't do anything spammy or blackhat. We hadn't even fully optimized his site yet - we were just finishing up his competitor research and were planning on a full site optimization next week... so we're at a complete loss as to what happened. Also, he's not ranking for any of the vehicles in his inventory. Our vehicle pages always rank on page 1 or 2, depending on how big the city is... you can always search "year make model city" and see our customers' sites (whether they're doing SEO or not). This guy's cars aren't showing up... so we know something is going on... Any help would be a lifesaver. We've been doing this for quite some time now, and we've never had a site get penalized. Since the reconsideration request didn't help, we're not sure what to do...

Need help with Joomla duplicate content issues
One of my campaigns is for a Joomla site (http://genesisstudios.com) and when my full crawl was done and I review the report, I have significant duplicate content issues. They seem to come from the automatic creation of /rss pages. For example: http://www.genesisstudios.com/loose is the page but the duplicate content shows up as http://www.genesisstudios.com/loose/rss It appears that Joomla creates feeds for every page automatically and I'm not sure how to address the problem they create. I have been chasing down duplicate content issues for some time and thought they were gone, but now I have about 40 more instances of this type. It also appears that even though there is a canonicalization plugin present and enabled, the crawl report shows 'false' for and rel= canonicalization tags Anyone got any ideas? Thanks so much... Please help....
Hi Guys! Ok a bit of a funny one here which is causing a confusion between us and a web designer and I was wondering if anyone on here might be able to help. Just a bit of back ground for you, the website has been built on Concrete 5 and when we tried to building a sitemap we found over 110,000 pages. When we spoke to the web designer they have told us that within Google webmaster tools, Google has only indexed 58. But.... (and this is where things get a little confusing, so bare with me.) I thought that cant be right so into the Google search bar I put in site:www.sitename.co.uk and had 217 results appear. So google cant have just 58 pages indexed, right? So after speaking to the designer he then posted on the Concrete 5 help forum, to try and help figure it out. I have posted his exact forum post below that the web designer has asked: I'm having some issues where a site we are working on seems to be making multiple pages going to the same page. An SEO specialist has run a report and found a number of duplicate pages created by C5. We are concerned that this is going to dilute or worse penalise the way google sees the site. http://www.sitename.co.uk/

Also is there a way of getting rid of the ones that are there? We've done a number of sites in C5 and are beginning to get concerned about this... So I guess my question is: If I can access the same content via 4-5 different cID's is that classed as duplicate content? Thanks in advance guys, and any help would greatly appreciated. 🙂0
