They are a client who has been hit pretty hard by Penguin 2.0 after we were just starting to grow in April. I am getting different opinions from SEO different agencies and I'd rather ask "the Moz community"

I think we have a similar school of thought to that. We will continue to add good quality links and go for high authority links over a sustained period of time.
Unfortunately we worked with a bad SEO provider in the past who claimed "Google moved the goalposts" - this is utter none-sense as they just used spammy tactics for their clients to make money. In many ways I'm glad Google have updated their algorithm to be more sophisticated as it is rewarding the better SEO's & Link builders.
Eventually I think those bad links that are still in our profile will be diluted and we will remove them as I think they will negatively affect us at some point in the future i.e. "Panda 3.0" but that might be a few months off yet.

You could ask 50 SEOs this question and get 50 different answers - simply because Penguin case studies and definitive guides are pretty much non-existent.
Is it a cop-out to say: "You need to both?"
Part of me thinks: if you're under an algorithmic penalty - so long as the algorithm sees those bad links in your profile you will always have the algorithm's effect on the site. So by that logic, you'd want to remove all the bad links.
But then we need to remember - this is an algorithm. Has it seen some of the bad links but not classed them as "spammy/bad"? Those blog comments for instance, has the algorithm taken them into account? Or even registered them?
The point is that if you remove or disavow these spammy links, you could see your ranking decrease further, as they could be powering up your site still. With your traffic and keywords recovering somewhat, this might not be a thing you want to do.
If a gun was put to my head - I'd go on the notion that removing or disavowing all of the bad links would be the most definitive way of removing the algorithmic penalty completely from your site. However, all of those links would need to be replaced and I'm also living in a "perfect world" scenario. Many people are sceptical over whether a completely recovery is even possible and if using the disavow tool is pretty much like opening up to crimes before Google.
It's just so hard to judge. Looking at what's happening right now - I'd continue with the route of adding high quality and authoritative links to your site and monitor keyword and traffic progression. If it keeps recovering - great. If, eventually. the progression halts for a few months and won't improve no matter what you do - and you are not at a traffic or keyword level that you would be happy with - I'd then maybe look at the remaining bad links and say "you know what - you're holding us back now more than you (potentially) may be benefiting us. We're gonna get rid of you." Be completely thorough at this stage.
You'll probably see a rankings dip, but hopefully by resuming the healthy link building process you can reach new heights, which would hopefully vindicate the decision.

We have been trying to remove a large number of the bad links but it seems we need to continue in this process. Can we just continue to build good links to de-spam our overall profile or do all the bad links need to be removed?
Since the recent refresh by Google on Friday 12th July, we have noticed an increase in traffic and the keyword rankings that were negatively effected have started to improve.
We think we need to continue to improve the % of good links to the site but I feel this might be too simplistic.

It coincides your organic traffic levels with major Google updates, so you may be able to see on the first Penguin refresh of the new algorithm whether or not the traffic fell with it. Correlation does not necessarily equal causation, but if there is a drop around the time of the update, it could well be a Penguin penalty.
Worth noting that the new Penguin algorithm looks to be having a stagnated effect on the SERPs - not like the previous update/aftermath/carry on system of old. So your traffic drop may not coincide with the update on that tool, but the site could still be effected by the algorithm.
Looking at the site's backlinks - there's definitely some evidence that would suggest a penalty could be problem. Comment spam, such as here, and here looks to make up a large portion of the backlinks to the website. There is also quite a lot of commercial, exact match anchor text links as well, which could be a problem.

Google penalty removal expert questions
We have searched online for a Google penalty “expert” (individual or company) and have located what appear to be “experts”. Please provide feedback on the following 2 individuals/companies we have found that can help with penalty removal. Have you or one of your clients used either of the “experts” below? Spanish equivalent of MOZ? need help with understanding Google.es
I try to keep up to date with everything SEO to ensure my sites rank well.. marblerenovation.com & Trailersafe.co.uk I now have a spanish site that I am having trouble ranking well for clima2000egara.es I have recently found out (by asking our lovely moz community) that googles algorithms are not rolled our world wide. SO I have no idea where I am at with Google.es. Does anyone know how I can find out at what stage google.es is at? and what the last update was? and whether there is an equilalent community like Moz for Spain? I am fluent spanish so the language won't be a problem.. Thanks in advance for all your help

Manual action penalty by Google
Hello, We have a big well-known brand - www.titanbet.com. This brand is well established and the site has been live for almost 4 years now ranking very well on some very strong KWs. we received a message from Google on Aug 29<sup>th</sup> saying “Google has detected a pattern of artificial or unnatural links pointing to your site” and that “Google has applied a manual spam action to titanbet.com/” The past 2 weeks since the penalty was received we saw some of our major KWs drop in rankings. BUT all brand related KWs were still ranked 1<sup>st</sup> Over the last weekend the penalty has worsen and we no longer rank on any of the brands KWs (we find the site in 5<sup>th</sup> page at best). Moreover, when searching for a sentence from the any of the page on the site in Google, we see other sites ahead of us in the SERPs. Based on the message we originally received from Google we have started cleaning some of the bad links to the site. We found a lot of links from bad sites, some of them are not indexed and probably penalized as well, some are from affiliate websites and some are from some automatic indexation websites based in China and Russia

we have started reaching out to some of these sites to try and have them remove our links. We are also worried about the duplication of our site. We have found many other sites (mostly affiliate websites) have copied and in some cases completely duplicated our content. Google for some reason has chosen to penalize us for this. Although we do not have control over these other sites. We have run copyscape to try and figure out which pages are the most problematic and we will try to re-write the content on these pages. But what if the other sites copy us again? Any suggestions on the above would be appreciated as we try to understand why Google has penalized us. thank you Titan Bet Team0 -

Anyone else know much about the Google Pirate penalty?
The Google 'Pirate' (no official name) seems to have gone largely undiscussed since it was launched last - Fri 10th August http://insidesearch.blogspot.co.uk/2012/08/an-update-to-our-search-algorithms.html. The idea of it is to ensure those 'Pirating' content or abusing trademarks e.g. fake ugg boot sites and file sharing sites do not appear higher in the search results than the genuine websites. Google is using DMCA take down requests for labeling sites as Pirate and demote their rankings, Im amazed not even seomoz has covered the subject yet as far as I can see, yet it is a hugely important new update, albeit affecting a relatively small number of sites now, and in some cases (at least one I know first hand) seemingly without justification (the example I know is not a file sharing, fake goods, trademark abusive site at all.) Google updating its search algorithm based on DMCA take down requests seems a bit strong - these are takedown requests, not legal proof that a site is infringing a trademark. A real weapon for negative SEO? Anyone else had experience of the pirate update or know much more about it? Outside Danny Sullivan I dont see many SEO folk covering it. What is your Biggest SEO selling point to prospective clients?
Typically, our SEO questions are around "how to's" and etc. So, to change it up I will ask a business question: What is your biggest selling point when presenting your SEO services to a new client? In a spirit of transparency, I will tell you mine ahead of time. With PPC, TV, Radio, and Print at some point in time that ad comes to an end. When it ends, that is it. There is no residual from that advertisement - or very minimal at best. With SEO, once you are ranked well and well optimized you continue to get clients for a much longer period of time. With clients who TV and print, this rings especially true and is easily provable. I can't wait to hear yours.
