Site been plagiarised - duplicate content

Hi,
I look after two websites, one sells commercial mortgages the other sells residential mortgages.
We recently redesigned both sites, and one was moved to a new domain name as we rebranded it from being a trading style of the other brand to being a brand in its own right.
I have recently discovered that one of my most important pages on the residential mortgages site is not in Google's index. I did a bit of poking around with Copyscape and found another broker has copied our page almost word-for-word.
I then used copyscape to find all the other instances of plagiarism on the other broker's site and there are a few! It now looks like they have copied pages from our commercial mortgages site as well.
I think the reason our page has been removed from the index is that we relaunced both these sites with new navigation and consequently new urls. Can anyone back me up on this theory?
I am 100% sure that our page is the original version because we write everything in-house and I check it with copyscape before it gets published, Also the fact that this other broker has copied from several different sites corroborates this view.
Our legal team has written two letters (not sent yet) - one to the broker and the other to the broker's web designer. These letters ask the recipient to remove the copied content within 14 days. If they do remove our content from our site, how do I get Google to reindex our pages, given that Google thinks OUR pages are the copied ones and not the other way around? Does anyone have any experience with this? Or, will it just happen automatically? I have no experience of this scenario!
In the past, where I've found duplicate content like this, I've just rewritten the page, and chalked it up to experience but I don't really want to in this case because, frankly, the copy on these pages is really good! And, I don't think it's fair that someone else could potentially be getting customers that were persuaded by OUR copy.
Any advice would be greatly appreciated.

Thank you for all your help! I reported them to Google using the link you posted and already the other site's URLs that had copied us have been removed and our pages have been put back in the index.
I have to say I am absolutely astounded that Google responded so quickly!

There is still a way to promote those pages, just not using Google organic to do so. Modify some of the content, create a press release, promote that page using social networks, and drive interest to that page and your site the old fashioned way. PPC is always an option as well. Remember, there are many ways to get traffic, don't lose hope or the vision.

First of all, please accept my sincere thanks. I REALLY appreciate everyone's contribution.
Now, I just wanted to tell you all what, as a company, we've decided to do.
- We've written letters to: The company that copied us, their web designer and their host, asking them to remove the copied content within 14 days of the letters.
- We've 'reported' them to Google, via one of the links that David posted (https://support.google.com/legal/troubleshooter/1114905?hl=en)
- We've reported them for scraping, using the link that Paddy posted
Hopefully, this problem will go away, but I hate to think how much business we may have lost as a result - the two pages they've copied are really important sales pages (remortgage and first time buyer) so for us, it's a massive shame.

Once their version is removed/rewritten, resubmit your site to Google in every way that you can.
1. Fetch as Google
2. Change sitemap created dates to current day
3. Change crawl frequency in sitemap to daily
4. Check for proper 301 redirects from old pages, when you moved/modified the site to separate branding.
5. Submit the URL in question to Google, and letting them know that someone has copied your site's content. They should be able to see that your was created first.Here are a few links to help:

It really depends on the web host whether they will follow it or not. Some that are soley based in the UK might not. If they have US based servers or the site is hosted in the US more than likely they will. It is worth a shot though, I try to rattle as many cages as possible. Yes, I redirected everything using 301 redirects - page to page. I also used the change of address tool in webmaster tools for the site that changed domains.
I don't know if using DMCA will be appropriate - isn't that a US-only thing or can site owners in the UK use it too? If I can, I will use it.

After they drop out of the searches google will index your site as a the canonical site with that content on it. So that part happens manually. Also, when you relaunched, did you redirect everything from the old site? That helps preserve link juice and at the same time gives search engines a pointer that the address of a page has changed to this new address.
One thing I would suggest is having a DMCA take down notice draft and sent to the host as well. If the other people you send letters to tell you to go pound sand, normally the host does not.

Duplicating content from manufacturer for client site and using canonical reference.
We manage content for many clients in the same industry, and many of them wish to keep their customers on their individualized websites (understandably). In order to do this, we have duplicated content in part from the manufacturers' pages for several "models" on the client's sites. We have put in a Canonical reference at the start of the content directing back to the manufacturer's page where we duplicated some of the content. We have only done a handful of pages while we figure out the canonical reference potential issue. So, my questions are: Is this necessary? Does this hurt, help or not do anything SEO-wise for our ranking of the site? Thanks!

What is best practise for markup in a nav bar, avoid duplicate content.
I'm wondering what's best practise for markup in the nav bar. So if we have <nav> Can we have headers in there, does it help? If we do, would a H1 confuse google as to wether that is the H1 of importance of the one in thein the </nav>

Woocommerce SEO & Duplicate content?
Hi Moz fellows, I'm new to Woocommerce and couldn't find help on Google about certain SEO-related things. All my past projects were simple 5 pages websites + a blog, so I would just no-index categories, tags and archives to eliminate duplicate content errors. But with Woocommerce Product categories and tags, I've noticed that many e-Commerce websites with a high domain authority actually rank for certain keywords just by having their category/tags indexed. For example keyword 'hippie clothes' = etsy.com/category/hippie-clothes (fictional example) The problem is that if I have 100 products and 10 categories & tags on my site it creates THOUSANDS of duplicate content errors, but If I 'non index' categories and tags they will never rank well once my domain authority rises... Anyone has experience/comments about this? I use SEO by Yoast plugin. Your help is greatly appreciated! Thank you in advance. -Marc

Why is Google Reporting big increase in duplicate content after Canonicalization update?
Our web hosting company recently applied a update to our site that should have rectified Canonicalized URLs. Webmaster tools had been reporting duplicate content on pages that had a query string on the end. After the update there has been a massive jump in Webmaster tools reporting now over 800 pages of duplicate content, Up from about 100 prior to the update plus it reporting some very odd pages (see attached image) They claim they have implement Canonicalization in line with Google Panda & Penguin, but surely something is not right here and it's going to cause us a big problem with traffic. Duplicate Content in News Section
Our clients site is in the hunting niche. According to webmaster tools there are over 32,000 indexed pages. In the new section that are 300-400 news posts where over the course of a about 5 years they manually copied relevant Press Releases from different state natural resources websites (ex. http://gfp.sd.gov/news/default.aspx). This content is relevant to the site visitors but it is not unique. We have since begun posting unique new posts but I am wondering if anything should be done with these old news posts that aren't unique? Should I use the rel="canonical tag or noindex tag for each of these pages? Or do you have another suggestion?

Penalised for duplicate content, time to fix?
Ok, I accept this one is my fault but wondering on time scales to fix... I have a website and I put an affiliate store on it, using merchant datafeeds in a bid to get revenue from the site. This was all good, however, I forgot to put noindex on the datafeed/duplicate content pages and over a period of a couple of weeks the traffic to the site died. I have since nofollowed or removed the products but some 3 months later my site still will not rank for the keywords it was ranking for previously. It will not even rank if I type in the sites' name (bright tights). I have searched for the name using bright tights, "bright tights" and brighttights but none of them return the site anywhere. I am guessing that I have been hit with a drop x place penalty by Google for the duplicate content. What is the easiest way around this? I have no warning about bad links or the such. Is it worth battling on trying to get the domain back or should I write off the domain, buy a new one and start again but minus the duplicate content? The goal of having the duplicate content store on the site was to be able to rank the category pages in the store which had unique content on so there were no problems with that which I could foresee. Like Amazon et al, the categories would have lists of products (amongst other content) and you would click through to the individual product description - the duplicate page. Thanks for reading

Duplicate Content Question
My client's website is for an organization that is part of a larger organization - which has it's own website. We were given permission to use content from the larger organization's site on my client's redesigned site. The SEs will deem this as duplicate content, right? I can "re-write" the content for the new site, but it will still be closely based on the original content from the larger organization's site, due to the scientific/medical nature of the subject material. Is there a way around this dilemma so I do not get penalized? Thanks!

Duplicate page content and Duplicate page title errors
Hi, I'm new to SeoMoz and to this forum. I've started a new campaign on my site and got back loads of error. Most of them are Duplicate page content and Duplicate page title errors. I know I have some duplicate titles but I don't have any duplicate content. I'm not a web developer and not so expert but I have the impression that the crawler is following all my internal links (Infact I have also plenty of warnings saying "Too many on-page links". Do you think this is the cause of my errors? Should I implement the nofollow on all internal links? I'm working with Joomla. Thanks a lot for your help Marco
