Google favoring old site over new site...

Hi,
I started a new site for a client: www.berenjifamilylaw.com. His old site: www.bestfamilylawattorney.com was too loaded up with bad links.
Here's the weird part: when you Google: "Los Angeles divorce lawyer" you see the old site come up on the 21st page, but Google doesn't even show the new site (even though it is indexed). It's been about 2 weeks now and no change.
Has anyone experienced something like this? If so, what did you do (if anything). Also, I did NOT do a 301 redirect from old to new b/c of spammy links.

Also, the new page's meta titles & descriptions are fairly spammy. Those meta descriptions ALL start with the main keyphrase. It's also in almost every title.
Many pages have two meta descriptions as well - not great for SEO.
So there are also a few technical things to clean up but I would focus on the 301 for the moment.

I see 260ish links for the old site in Ahrefs and 12 for the new. The old site had plenty of decent backlinks (lauflaw, askthepalawyer, goinglegal, etc.) and a few that definitely needed to go (londover, the India spam, poeticdictionary etc.)
The links on the new one are good - but there aren't many.
I would highly recommend a disavow on the old domain and then a page by page 301 to the most relevant page. By passing some of that good juice on the old site you can quickly jumpstart the rankings for the new one but starting by cleaning up his profile and doing things right going forward.
260 links isn't much to go through for a disavow. You can quickly get a win here with this plan.

That also approx per category 500 products via load more feature. Why isn't Google indexing this site?

Can Google penalize your site without sending you a Manual Spam Action?
I had a massive drop in traffic in Mid 2013, and a slow reduction since then. It has sort of leveled off now, but it's not exactly climbing I've never received a manual spam action. The answer to my question seems pretty obvious, now that I write it out... but have you heard of anyone getting penalized, without specifically receiving a warning? Thanks!

Google webmaster tools showing "no data available" for links to site, why?
In my google webmaster account I'm seeing all the data in other categories except links to my site. When I click links to my site I get a "no data available" message. Does anyone know why this is happening? And if so, what to do to fix it? Thanks.

200 for Site Visitors, 404 for Google (but possibly 200?)
A 2nd question we have about another site we're working with... Currently if a visitor to their site accesses a page that has no content in a section, it shows a message saying that there is no information currently available and the page shows 200 for the user, but shows 404 for Google. They are asking us if it would be better to change the pages to 200's for Google and what impact that might have considering there would be different pages displaying the same 'no information here' message.

So What On My Site Is Breaking The Google Guidelines?
I have a site that I'm trying to rank for the Keyword "Jigsaw Puzzles" I was originally ranked around #60 or something around there and then all of a sudden my site stopped ranking for that keyword. (My other keyword rankings stayed) Contacted Google via the site reconsideration and got the general response... So I went through and deleted as many links as I could find that I thought Google may not have liked... heck, I even removed links that I don't think I should have JUST so I could have this fixed. I responded with a list of all links I removed and also any links that I've tried to remove, but couldn't for whatever reasons. They are STILL saying my website is breaking the Google guidelines... mainly around links. Can anyone take a peek at my site and see if there's anything on the site that may be breaking the guidelines? (because I can't) Website in question: http://www.yourjigsawpuzzles.co.uk UPDATE: Just to let everyone know that after multiple reconsideration requests, this penalty has been removed. They stated it was a manual penalty. I tried removing numerous different types of links but they kept saying no, it's still breaking rules. It wasn't until I removed some website directory links that they removed this manual penalty. Thought it would be interesting for some of you guys.

Migrating a site with new URL structure
I recently redesigned a website that is now in WordPress. It was previously in some odd, custom platform that didn't work very well. The URL's for all the pages are now more search engine friendly and more concise. The problem is, now Google has all of the old pages and all of the new pages in its index. This is a duplicate problem since content is the same. I have set up a 301 redirect for every old URL to it's new counterpart. I was going to do a remove URL request in Webmaster Tools but it seems I need to have a 404 code and not a 301 on those pages to do that. Which is better to do to get the old URL's out of the index? 404 them and do a removal request or 301 them to the new URL? How long will it take Google to find these 301 redirects and keep just the new pages in the index?
