How Best to Handle 'Site Jacking' (Unauthorized Use of Someone else's Dedicated IP Address)

Anyone can point their domain to any IP address they want. I've found at least two domains (same owner) with two totally unrelated domains (to each other and to us) that are currently pointing their domains to our IP address. The IP address is on our dedicated server (we control the entire physical server) and is exclusive to only that one domain (so it isn't a virtual hosting misconfiguration issue) This has caused Google to index their two domains with duplicate content from our site (found by searching for site:www.theirdomain.com) Their site does not come up in the first 50 results though for any of the keywords we come up for so Google obviously knows THEY are the dupe content, not us (our site has been around for 12 years - much longer than them.)
Their registration is private and we have not been able to contact these people. I'm not sure if this is just a mistake on the DNS for the two domains or it is someone doing this intentionally to try to harm our ranking. It has been going on for a while, so it is most likely not a mistake for two live sites as they would have noticed long ago they were pointing to the wrong IP.
I can think of a variety of actions to take but I can find no information anywhere regarding what Google officially recommends doing in this situation, assuming you can't get a response. Here's my ideas.
a) Approach it as a Digital Copyright Violation and go through the lengthy process of having their site taken down. Pro: Eliminates the issue. Con: Sort of a pain and we could be leaving possibly some link juice on the table?
b) Modify .htaccess to do a 301 redirect from any URL not using our domain, to our domain. This means Google is going to see several domains all pointing to the same IP and all except our domain, 301 redirecting to our domain. Not sure if THAT will harm (or help) us? Would we not receive link juice then from any site out there that was linking to these other domains? Con: Google will see the context of the backlinks and their link text will not be related at all to our site. In addition, if any of these other domains pointing to our IP have backlinks from 'bad neighborhoods' I assume it could hurt us?
c) Modify .htaccess to do a 404 File Not Found or 403 forbidden error?
I posted in other forums and have gotten suggestions that are all over the map. In many cases the posters don't even understand what I'm talking about - thinking they are just normal backlinks. Argh! So I'm taking this to "The Experts" on SEOMoz.

Hi, I made the mistake of hiring a freelancer to work on my website [in2town.co.uk](link url) but after having a good website things went from bad to worse. Can anyone please advise what tools i should be using to find out the problems and solve them, and can anyone offer advice please on what to do to solve this.

Problems with WooCommerce Product Attribute Filter URL's
I am running a WordPress/WooCommerce site for a client, and Moz is picking up some issues with URL's generated from WooCommerce product attribute filters. Deindexed site - is it best to start over?
A potential client's website has been deindexed from Google. We'd be completely redesigning his site with all new content. Would it be best to purchase a new url and redirect the old deindexed site to the new one, or try stick with the old domain?

We're no longer turning up in Google SERP for our brand search when we used to be #1 after our site update. Any ideas why?
We recently updated our website and during the push, someone mistakenly 301 redirected "www.brandx.com" to "brandx.com" instead of the otherway. Since then, our website no longer turns up for the search "brandx" on Google. We have reversed the mistake a few days ago, but we're still not turning up, and we used to rank #1 in Google SERP. Could it just be due to timing between the crawls and that our www. site didn't make it in Google's index due to this mistake? We have submitted our new sitemap to google a couple of days ago as well, as a side we're still showing up #1 in Bing's results however. And it should still show up based on SEOMoz's SERP report. Any help would help as I'm growing increasingly concerned.

Best way to handle redirection for products that come in and out of inventory.
We have a large volume of products that rotate seasonally. From an SEO perspective we are looking for the best method on how to handle these issues. Currently when crawler or user encounters a URL to a product that is no longer in inventory we are looking at two things. One, the request comes in and send a 200 to a page that says ITEM NOT FOUND. Option 2, is simply send them to a 404. The product may or may not be put back into production. What is the best method to handle this?

Switching ecommerce CMS's - Best Way to write URL 301's and sub pages?
Hey guys, What a headache i've been going through the last few days trying to make sure my upcoming move is near-perfect. Right now all my urls are written like this /page-name (all lowercase, exact, no forward slash at end). In the new CMS they will be written like this: /Page-Name/ (with the forward slash at the end). When I generate an XML sitemap in the new ecomm CMS internally it lists the category pages with a forward slash at the end, just like they show up through out the CMS. This seems sloppy to me, but I have no control over it. Is this OK for SEO? I'm worried my PR 4, well built ecommerce website is going to lose value to small (but potentially large) errors like this. If this is indeed not good practice, is there a resource about not using the forward slash at the end of URLS in sitemaps i can present to the community at the platform? Duplicate content and URL's
Hi Guys, Hope you are all well. Just a quick question which you will find nice and easy 🙂 I am just about to work through duplicate content pages and URL changes. Firstly, With the duplicate content issue i am finding the seo friendly URL i would normally direct to in some cases has less links, authority and root domain to it than some of the unseo friendly URL's. will this harm me if i still 301 redirect them to the seo friendly URL. Also, With the url changed it is going to be a huge job to change all the url so they are friendly and the CMS system is poor. Is there a better way of doing this? It has been suggested that we create a new webpage with a friendly URL and redirect all the pages to that. Will this lose all the weight as it will be a brand new page?
