Is this duplicate content?

I'm optimizing a Magento site and have a question regarding duplicate content. Currently, you can dig down to an individual product listings with URLs similar to this:
(1) http://www.foo.com/category/sub-category/sub-sub-category/item.html
However, we also have a "Top 50" area, with a link to the same page; however, the URL for that page is:
(2) http://www.foo.com/item.html
Both are dynamic, so a static page for (2) with different content is out of the question. I asked IT to have both (1) and (2) point to exactly the same page, within the same categor(ies), but they said I would have choose one or the other
So, here are my questions:

Will Google consider the pages to be duplicates of each other, and thus incur a penalty;

If I were to choose one structure, which would be the "friendliest?"
I've think I've come across questions similar to this in Q&A, but haven't been able to locate them; so, I'm sorry to be posting a "duplicate question." I've been busy writing completely different product descriptions, nice and deep and value-rich, for more than 300 items and categories and am only now starting to look at current SEO protocols; I'm hoping to ask Google for a site reevaluation in another 2 weeks or so.

I would definitely point the link to #2 (http://www.foo.com/item.html) - because of the directory structure in the URL.
You could NOINDEX http://www.foo.com/category/sub-category/sub-sub-category/item.html with robots.txt.

Content - Similar but not exactly the same content - Duplicate or Spammy?
Hey, so I have been wondering for some time now as some pages will get indexed and others won't appear at all. That makes me think that I am either creating to similar content or it is becoming too spammy. Take these two pages I created for example. The body content is very similar but h tags, meta tags and title are different. So my questions is; would pages not be displaying due possibly being too similar and spammy or duplicate? How to fight against a site always "re-write" your content?
A site is always copying our content then re-write to their site, how to fight against this kind of action? (Many of those copied content can get a rank very closely behind us, which will grab some of our visits ) I tried to find DMCA, but as they have changed some paragraphes, etc, DMCA can't punish them as copying. Hi, I have a new site http://www.homeforbusiness.co.uk. I want to encourage traffic to the site by sharing some of my content with other related websites which have a higher PR ranking and traffic for a link to my site. Is this going to upset Google re-duplicate content and devalue my site and stop any organic rankings in the future? Equally some high PR sites which have a good synergy with mine such as http://thewomensbusinessclubs.com/ allow me to add my RSS feed with their blog network. How can I use my unique content to my advantage?
Hi, I run http://ablemagazine.co.uk - we also put out a print magazine every 2 months (the biggest disability magazine in Britain) This means we have loads of unique content (around 30 feature stories and 30 news stories every 2 months) Just wondering how I can use this to my advantage?
