Wordpress themes causing google penalty(need experts to settle a debate)

Hi, I have been having a disagreement with another online marketing company. We are both promoting the same product under a different brand name but we ended up using the same theme to build our WordPress sites off of but in no way is the content the same.
They are telling me that using the same theme in the same industry will cause a Google penalty. I do not believe this and do not see this causing a problem. The sites are relatively new so there is no proof of traffic dropping or penalties as of yet.
What is everyone's professional opinion on this? Can a WordPress theme cause duplicate content penalty? If so would that not mean that anyone using themes will have some sort of penalty?

This is exactly what I thought I am not sure why they are so confident that this will cause a penalty. The structure of the sites are definitely different a no links have been made between them as they are essentially two site competing in the same market under different brands.
I am going to send them this thread so I can finally end this ongoing debate. Its a waste of my time.

The theme generally doesn't matter at all. As long as the content is unique on your site, then there's no problem whatsoever. Like previously mentioned, there are plenty of people using the same WordPress theme, and it's the content that's unique, not the theme.

It's a pretty straight forward 'no' Tyson. If all that is used that is the same is the theme, there is no penalty to be handed out here.
If they are concerned about it, tell them to change their theme, but you don't need to worry about this at all

I think that if you have completely different content this should not be an issue.
You should also notice you guys are not
- using the same phone / visible email address
- linking between each other (tough its only 2 sites)
- have the exact same structure
My other recommendation is that one of you change the structure (not the theme)... each theme - or at least the good ones allow you to create a different structure, different widgets, different icons and similar structure related items.
For example you can use additional tabs in your homepage, use different widgets in your footer and so fourth.
Keep in mind that many people buy the same theme and in a world where themes are content related in many cases meaning real-estate themes, transportation themes and so on it not logical that Google would rate a site just based on the theme.

Have Your Thoughts Changed Regarding Canonical Tag Best Practice for Pagination? - Google Ignoring rel= Next/Prev Tagging
Hi there, We have a good-sized eCommerce client that is gearing up for a relaunch. At this point, the staging site follows the previous best practice for pagination (self-referencing canonical tags on each page; rel=next & prev tags referencing the last and next page within the category). Knowing that Google does not support rel=next/prev tags, does that change your thoughts for how to set up canonical tags within a paginated product category? We have some categories that have 500-600 products so creating and canonicalizing to a 'view all' page is not ideal for us. That leaves us with the following options (feel it is worth noting that we are leaving rel=next / prev tags in place): Leave canonical tags as-is, page 2 of the product category will have a canonical tag referencing ?page=2 URL Reference Page 1 of product category on all pages within the category series, page 2 of product category would have canonical tag referencing page 1 (/category/) - this is admittedly what I am leaning toward. Any and all thoughts are appreciated! If this were in relation to an existing website that is not experiencing indexing issues, I wouldn't worry about these. How does Google's AJAX Announcement Impact the likes of AngularJS?

Should Blog Category Archive URLs be Set to "No-Index" in Wordpress?
It appears that Google Webmaster Tools is listing about 120 blog archives URLs in Google Index>Index Status that should not be listed. Our site map contains 650 pages, but Google shows 860. Pages like: <colgroup><col width="464"></colgroup>

Our site map shows about 650 pages, yet Google show these extra pages. We would prefer that they not be indexed. Note that these pages do not appear when we run a site:www.nyc-officespace-leader.com search. The site has suffered a drop in ranking since May and we feel it prudent to keep Google from indexing useless URLs. Before May 650 pages showed on the Webmaster Tools Index status, and suddenly in early June when we upgraded the site the index grew by about 175 pages. I suspect the 120 blog archives URLs may have something to do with it. How can we get them removed? Can we set them to "No-Index", or should the robot text be used to remove them? Or can some type of removal request be made to Google? My developers have been struggling with this issue since early June. The bloat on the site is about 175 URLs not on the site map. Is there any go to authority on this issue (it is apparently rather complicated) that can provide a definitive answer? Thanks!!

Should i not use hyphens in web page titles? Google Penalty for hyphens?
all the page titles in my site have hyphens between the words like this: http://texas.com/texas-plumbers.html I have seen tests where hyphenated domain names ranked lower than non hyphenated domain names. Does this mean my pages are being penalized for hyphens or is this only in the domain that it is penalized? If I create new pages should I not use hyphens in the page titles when there are two or more words in the title? If I changed all my page titles to eliminate the hyphens, I would lose all my rankings correct? My site is 12 years old and if I changed all these titles I'm guessing that each page would be thrown in the google sandbox for several months, is this true? Thanks mozzers!

Does Google penalise for alot of advertising on your site?
I look after the search side of a decorating website on which we carry a large amount of advertising from external brands as that is our business model. Do you know if we would get penalised for having too much advertising - would it be deemed to affect the user experience? Many thanks for your help on this.

How Does Google differentiate a keyword you are optimizing for and a non-keyword?
So, let's say that my company is called John's Business Consulting and I offer outsourced HR work (recruiting, evaluating, personality assessments, background checks). So for my home page I want "Business Consulting" to be my keyword that I want to rank for. But "recruiting services", "talent development" are all words that describe a service that I offer and could potential be keywords, how do I get Google to not dilute my authority for "business consulting"?
