Yet another Negative SEO attack question.

I need help reconciling two points of view on spammy links.
On one hand, Google seems to say, "Don't build spammy links to your website - it will hurt your ranking." Of course, we've seen the consequences of this from the Penguin update, of those who built bad links got whacked.
From the Penguin update, there was then lots of speculation of Negative SEO attacks. From this, Google is saying, "We're smart enough to detect a negative SEO attack.", i.e: http://youtu.be/HWJUU-g5U_I
So, its seems like Google is saying, "Build spammy links to your website in an attempt to game rank, and you'll be penalized; build spammy links to a competitors website, and we'll detect it and not let it hurt them."
Well, to me, it doesn't seem like Google can have it both ways, can they? Really, I don't understand why Competitor A doesn't just go to Fiverr and buy a boatload of crappy exact match anchor links to Competitor B in an attempt to hurt Competitor B. Sure, Competitor B can disavow those links, but that still takes time and effort. Furthermore, the analysis needed for an unsophisticated webmaster could be daunting.
Your thoughts here? Can Google have their cake and eat it too?

If it can be proven that the intention was to cause harm to another companies profits I would think you could be held liable. There is enough documentation on the web to show that Google penalizes for bad links and that negative SEO exists, if there is proof that you were doing what Google tells you not to do against your competition and it results in a penalty that Google says will happen, it seems like bad intentions can be proven and in that case you could be found guilty in a court of law. I am not aware of any precedents though.

you could be held liable in court.This would be another interesting tangent discussion. Of course, the defense would be the first amendment right of freedom of publishing. In my feeble knowledge, I'm not aware of a court case that has encountered this issue, but it's an interesting legal question: Could you be held civilly liable for merely publishing links?

I completely agree with your comments Steve. Especially when it comes to a niche where there are only a couple of big companies and it's seasonal. If you can knock out the competitor during their busiest month of the year you've done major damage to them and have benefited yourself greatly. It's a horrible, shady practice and even though Google initiated the penalty, if it is proven that you created these links my guess would be you could be held liable in court.

Why is competitor A spending their time and money trying to harm Competitor
B whenthey can simply protect themself with the Disavow Tool Why not
spend those time and money on building quality links.Buying links on Fiverr = $5 and five minutes.
Disavowing links = a couple of hours of analysis or paying someone a bit of cash for the analysis.
So, it's easier to create the havoc, than to clean it up. I'm sure we're all on the same page that such a technique isn't ethical, doesn't help you build up your business, is bad business karma, and so on. But, is it feasible? Apparently so. Especially when the stakes are high, for Commerce sites, it seems like this would become a tempting strategy for the less ethically inclined.

There is no way that Google can know (unless you are intentionally transparent about it) if someone you paid or someone a competitor paid built those links for you. Negative SEO is very real but it takes time and money to get a site penalized, and now it's easier than it ever was to disavow links and get a site back which helps take some of the punch out of the negative SEO business.

I think I see your point. However, if Competitor A buys low quality links to Competitor B, yes, they can use the disavow tool to remove the links and it will still take time for them to do so and effort but what is the point in this. Why is competitor A spending their time and money trying to harm Competitor B when they can simply protect themself with the Disavow Tool Why not spend those time and money on building quality links.
Competitor A is simply wasting time and money to buy links where Competitor B is spending time and effot to remove them. I don't see why anyone would do that.

Pharma Hack/Grey hat SEO. Cannot get site to rank, tons of incoming bad links
I have been working on a website trying to get it to show up in the SERPs again. It is being indexed which is great, it has some errors that I'm fixing now. But for the most part it should be ranking. It don't show any penalties going on, but when I did a backlink search we keep getting the cialis, viagra etc inbound links. First thought was Pharma Hack. But it's not a WP site and I recently rebuilt it. So whatever bad code could have been there it's not anymore. It doesn't show up in google either for the search site:www.mysite.com viagra cialis etc... So I'm wondering if anyone has any insight in a direction to point me? I don't understand what would be causing this to still not rank. Only thing it ranks for is it's name. Any suggestions would be very appreciated.

Using Yext - Opinions? Thoughts? Harmful effects on SEO?
Hi All, Does anyone have any experience using Yext? We have 36 locations across the US and I think it would be great to get our local listings knocked out efficiently. Can anyone provide information on the directories they list you in (perhaps Google places listings, for example)? Also, can anyone provide feedback as to whether or not there is any harm with blasting so many directories at once? I don't want to do anything that might harm our SEO rankings or provide low quality links. Thanks in advance!

Exploring this url: filterscanada.ca In Open Site Explorer, it is clear those guys bought one of those package available on site like eLance.com a low price over seas!!! Where freelancer around the word can be hired for a fews bucks. For example, I post a job on eLance for SEO and most of the freelancer submitting where from INDIA. For just a few hundreds dollars, you can get a complet SEO package. At first, the price was attractive, but when posting on seoMoz and doing research, I came to the conclusion, the techniques they use might hurt more the produce positive result... How can you get a D.A. of 45 using backlinks they get? I read all those things about Google algorithm, and Panda and Penguin and this and that... Being impossible to crack! Do you have a explanation? Question about local SEO when you serve many more cities than you have brick and mortar locations
My URL is: http://www.mollysmusic.org for the record.I run a music school that serves in-home lessons to a whole slew of cities. Since I only have 3 brick-and-mortar locations, I can't make google local profiles for all the cities served, but I want to get seen by those people searching in their own cities. Right now, our biggest competitor, takelessons.com, is top ranked for every single city you can think of, because they have individual web pages for every city served. Their content is repetitive and scrapey, and to me, that says "doorway page" which supposedly can get you de-indexed. I'm reluctant to do that because I'm afraid I'll get banned, but I have to compete. I also want a strategy that can scale when we move into new areas. Is there something that makes TakeLessons's content NOT a doorway page? What's the best practice for getting ranked in multiple individual cities if you run a service? Thanks in advance.

Can anyone recommend a Google-friendly way of utilising a large number of individual yet similar domains related to one main site?
I have a client who has one main service website, on which they have local landing pages for some of the areas in which they operate. They have since purchased 20 or so domains (although in the process of acquiring more) for which the domain names are all localised versions of the service they offer. Rather than redirecting these to the main site, they wish to operate them all separately with the goal of ranking for the specific localised terms related to each of the domains. One option would be to create microsites (hosted on individual C class IPs etc) with unique, location specific content on each of the domains. Another suggestion would be to park the domains and have them pointing at the individual local landing pages on the main site, so the domains would just be a window through which to view the pages which have already been created. The client is aware of the recent EMD update which could affect the above. Of course, we would wish to go with the most Google-friendly option, so I was wondering if anyone could offer some advice about how would be best to handle this? Many thanks in advance!
