Should I Disavow Links if there is No Manual Action

Hello,
I just recently took on a client that had hired a very black hat seo and used their service for roughly two years. He outsourced link building and the link profile is full of spun articles and blog commenting on chinese websites etc…
The anchor texts/pages used for all this spamming no longer rank, but there is no penalty in Webmaster tools manual actions.
I was thinking about disavowing some of the obviously spammy backlinks that exist but would that be raising a red flag that could lead to a manual action and even more negative movement?
Have you ever heard of anything like the situation i'm dealing with where its obvious the pages have been hit but there is no manual action? What do you all think/suggest? And Should I disavow some terrible links and potentially open a can of worms?

There are many link-based algorithmic actions that can hit a site, including Penguin, so just because you don't have a warning of a manual action doesn't mean that you're not in trouble. I can't see the data, but this doesn't seem to be speculative - you're basically saying that certain pages and keywords have clearly been devalued.
If you've ruled out technical issues with the pages (including duplicate/thin content issues), and you know the spammy links are targeting these pages, then I think disavowing is probably a good way to go. Ideally, try to have some of the links removed first, as that will make Google take the request more seriously (and disavow is basically a request, although it's semi-automated).
It's entirely possible, too, that you're already headed for a manual action, so even if you do nothing, the situation could get worse. If you were unaffected, I might suggest pruning some of the bad links and focusing your future link-building on better tactics, but you're already taking damage.

As Jeff say, there's no problem with proactively disavowing low quality links to your domain.

In the past, the disavow tool was the "tool of last resort." You weren't supposed to use it unless you'd had a manual action.
But Google's Matt Cutts has broken from the previously stated mantra on the disavow tool, and now is encouraging Webmasters to use it if they are worried if a link is from a bad domain, due to poor SEO (or someone else trying to hurt your site by creating bad links):

Malicious links on our site indexed by Google but only visible to bots
We've been suffering from some very nasty black hat seo. In Google's index, our pages show external links to various pharmaceutical websites, but our actual live pages don't show them. It seems as though only certain user-agents see the malicious links. Setting up Screaming Frog SEO crawler using the Googlebot user agent also sees the malicious links. Any idea what could have caused this or how this can be stopped? We scanned all files on our webserver and couldn't find any of malicious links. We've changed our FTP and CMS passwords, is there anything else we can do? Thanks in advance!

Is there any reason to Nofollow Internal Links or XML Sitemap?
I am viewing a new client's site and they have the following nofollow(S) on their site homepage. Is there a reason for this? Also, they people who originally built their site have a footer link on every page to their company (I guess to promote their work). They didn't "nofollow" that link lol... Hello, So I have a website (example.com). I have an ajax pop-up (example.com/#example) that I am receiving a bunch of links to. Since this pop-up (example.com/#example) is on my homepage, are these links giving juice to the homepage, or this pop-up, or both?

Black Hat Link Building Ethics Question
I have taken on the SEO/Inbound duties for my company and have been monitoring some of our competitors in the market space. In June one of them began a black hat link building campaign that took them from 154 linking root domains to about 7500 today. All of the links target either /header or /permalink/index and all have anchor text along the lines of "Windows 7 activation code." They are using forgotten forums and odd pages, but seem to be finding high DA sources to place the links. This has skyrocketed their DA (40 to 73), and raised their mozRank, mozTrust, and SERP positions. Originally I thought to report it to Google, but I wanted to wait a few weeks and see what the campaign did for them and if Google would catch on. I figured adding 81K links in 2 months would trigger something (honestly, if I was able to find out they were doing it then it's got to be obvious). But they have grown every week and no drop in rankings. So my question is would you report it? Or continue to wait and see? Technically they are not a "competitor" in the strictest sense of the word (we actually do sell some of their products as OEM), but I find the tactic despicable and it makes my efforts to raise our rankings and DA seem ineffective to people not in the know about SEO. Potential Implications of using the Disavow tool to remove thousands of links
So here's the situation. My companies site has over 30 thousand backlinks from Rippling.info These links all point to 3 product pages, some of which are no longer in production. Apparently a former employee was experimenting with some link farm ideas. My questions are; 1. does anyone here have experience with rippling.info? Is it legit? It seems like a link farm but Google allows adsense ads??? I thought Google was against link farms... 2. if I use the Disavow tool in Webmaster Tools to tell Google these 30k+ incoming links are to be ignored, will there be any consequences? -Google Analytics shows zero referral traffic since jan 1st 2012.

Google-backed sites' link profiles

Does this imply that the average root domain linking to the taxdonut site does so with 2857 links? The sites have no significant social media stats. The sites are heavily inter-linked. Also linked from the operating business, BHP Information Solutions (tagline "Gain access to SMEs"). Is this what Google would think of as a "natural" link profile? Interestingly, they've managed to secure links on quite a few UK local authority resources pages - generally being the only commercial website on those pages.

Methods for getting links to my site indexed?
What are the best practices for getting links to my site indexed in search engines. We have been creating content and acquiring backlinks for the last few months. They are not being found in the back link checkers or in the Open Site Explorer. What are the tricks of the trade for imporiving the time and indexing of these links? I have read about some RSS methods using wordpress sites but that seems a little shady and i am sure google is looking for that now. Look forward to your advice.

Linking Profile Gone Bad?!
Recently, I was looking over the linking profile for one of our large clients, and I noticed that a ton of spammy links were appearing. I have never purchase any links or done anything shady that would contribute to this large increase in bad links. It appears as though someone is trying to hijack the SEO of this company, and I don't know how to proceed. Currently, they have not been penalized by Google, but I would not be surprised if a penalty is on its way due to the obvious link spam. Is there any way to report this to Google to ensure that no penalties occer? Any advice on the issue is much welcomed! Thanks
