Re-writing articles, how does this effect SEO?

Hi there,
I noticed a competitor had re-created a couple of articles I wrote, but they made reference back to me in the article, can in anyway possible myself or their site be penalised for duplicate content? The article isn't completely copied word for word, however it is definitely shows some similarity.
Any advice around this?

I agree with Jonathan If the site is decent then there is no problem to get links from there. That would be great for you.

Thats such a great idea Jonathan, yes I will to the re-tweaking mine to make it even more unique and better then the last one to keep the link, the site that wrote the content have great authority!

If the link is from a decent site (i.e. not spammy \ black hat) and you want the link, normally what I do is just accept it knowing Google is sensible enough to know you are the original source from the backlink. However, what I also do is take the opportunity to update my own content seeing as someone else is now competing with your article. Just make your article better \ more unique, and it is a win win from your point of view.
If they have blatently copied just submit a GOogle DMCA request.

Has anyone been to SMX or any other SEO Conference?
Hello All, I have been given the opportunity to go to several conferences. But like most SEO guys, I have a tone of work, and need to use my time sparingly. The one conference that has peaked my interest is SMX. I was wondering if anyone has been to SMX before and if they recommend it. Also if anyone has any other conferences they would recommend, preferrably on the east coast, that would be interesting please let me know. Any answers are appreciated. Thank you.

Problem with SOME Indian based SEO companies, HELP!
First of all I want to say that I hire 2 great Indian SEOs at my company and this question is in no way meant to offend, or single anyone out. However It's come to a point where the amount of emails we receive for "Ethical SEO, High PR Guaranteed Link building Services, SEO professionals etc" from Indian based companies is costing us a lot of time on a daily basis to filter out spam from real enquiries. Blocking their emails is not even working as they use gmail accounts and multiple domain emails so we can't keep up with them. I have even spoken to some of the owners of these 'companies' and they admit using different email accounts so as not to be blacklisted. They also seem to believe that the opt-out option (which is legally required when sending out promotional emails) is itself optional!!!!! Now when I asked how exactly they were getting my email they said that they get info from the, and I quote "first page of Google"!!!!! So my question is the following; is there anyway I can block my site from showing up in a particular country altogether? Again this is in no way attacking ALL Indian based SEO companies, my beef is with the 74 (we counted) different 'companies' that are flooding our email with offers P.S. Is anyone else having these issues?

Node.js for SEO
We've got a client building a site using node.js (http://nodejs.org/) I'm not at all familiar with this and of course need to know how nodejs impacts SEO? Are you familiar with it? Any sites you know of using it? But as I said, bottom line - how will it impact the SEO on the site?

Punchy Friday: Too much SEO Education?
This is not a question really, just an observation. Yesterday I was listening to "Stuff You Should Know" podcast, and it was about "Tickling". They were addressing how it is impossible to tickle yourself, and they theorized it was because our brain is AWARE that it's your own hand doing the tickling. The first thought that came to my brain was that our brain had put a "NoFolow" link on the tickling page of our brain website when it is from our own hands. I'm reading WAY to much about SEO . . .
