Dealing with Spammy Affiliate Site Copies

We have a longstanding site that sells media files with a large number of digital products.
We offer a referral program with rewards for those that tell others about us.
In the last year, we have seen some sites popping up primarily in China that appear to be spammy looking advertisement based copies of our own site with product pages that link back to our actual products using a referral link/code. (no-follow links.)
These sites started popping out more when we noticed that some of their pages were outranking our own actual product pages.
Any thoughts on this? Our affiliate policy states that the affiliate program is meant to help and not harm our site. In one sense this is traffic to our site which is supposed to be a good thing, but if these pages are ranking above our own, that is not what we are wanting. I would bet these pages might get clicked on and due to the spammy nature of these sites, the user bounces and never actually gets to our website.
How would you handle something like this?

I would do both #1 and #2. If you can contact them and ask them to take the content and links down I would do that as well, documenting the request for future use in the DMCA complaint or in a disavow link request in GWT - if needed.

Yes, our affiliate system does allow for this if we want it to. We could pre-review for future affiliates, but the damage is already done in these current cases. We are talking 2-3 websites here that have probably thousands of pages of our products.
One of the sites is even using the .org version of our domain, but that one actually advertises our competitors products.... uh... yeah.... Not sure how we will deal with this trademark violation with a Chinese website yet, or if there is anything we can do, but it is a pretty serious issue.
The options I see are:
1. Based on our sign-up terms, we could suspend these affiliate accounts because they violate the terms by providing more harm than good.
2. These sites do list DMCA notices, so we could actually contact them under the DMCA and tell them to remove our content.
3. Do nothing, but try to get our pages to rank higher than these pages and consider it just another link to our site.

Links from a penalised site.
Hey Mozzers, Recently we have had a series of agencies in to pitch for work, one group mentioned that due to our association with a possibly penalised product review website, any links and activity associated with the brand would hinder our SEO. We currently have a good rating, but we are now no longer pushing our customers to the site as we move to a new platform. The current link back from this website is also no-followed. Linking to one of my own sites, from my site
Hi experts, I own a site for castingjobs (Site1) and a site for selling paintings (Site2). In a long time, I've had a link at the bottom of Site1, linking to Site 2. (Basicaly: Partnerlink: Link site 2). Site1 is for me the the only important site, since it's where Im making my monthly revenue. I added the link like 5 years ago or so, to try to boost site 2. My question is:

Why has my site dropped off the face of Google???
Hi All, My site was ranking well for a long time and suddenly can't be seen at all any more. I have been trying to figure this out for some time and can't get to the bottom of it. Funny thing is also even when searching for my site with a keyword "snowboard gulmarg" my URL www.klinehinmalaya.com does not appear and somewhere way back in the listing my another page www.klinehimalaya.com/packages.php comes up. How to decide on which site to 301 redirect
Hi there I'd like your opinions please! My client currently has their website at not-very-good-url.it which has a really good link profile they also have duplicate sites at: much-better-brand-name-url.it and much-better-brand-name-url.com but both these other sites have only a handful of links in. How important do you think a better brand url is? And therefore do you think it would be better to 301 to a better brand URL and take the risk that the link profile will get hit? Or leave the main site where it is and 301 the other two to it? Many thanks

medical site with no unique content
Hi I'm trying to promote an ecommerce site that sells vitamins and health goods. The site owner doesn't want to add texts in the product pages because it is medical material. therefore he Currently has non unique (duplicated) content in each product page' It is the same exact content all others have (taken From the manufacturer)' Any ideas? Ezine Articles - Copied Content on Site
One of my clients has a bunch of articles on the normal article syndication sites. They have duplicated these articles on their own site. Building a mobile site.

Can your site be penalised by backlinks?
Hi, I just wanted to get some clarification on whether Google would penalize your site if you had many links coming from a questionable site. We've been struggling with rankings for years even though we have one of the oldest sites in the industry with a good link profile and the site is well optimized. I was looking through webmaster tools and noticed that one website links to us over 100,000 times, all to the home page. The site is www.vietnamfuntravel.com. When I looked at the site it seems that they operate a massive links exchange, I'm not sure what the history is and why they link to us so much though. Is there any chance that this could impact us negatively? if it is then what would be the best way to deal with the situation? I could ask them to take the links down but can't guarantee they would do it quickly (if at all). Would blocking their domain from our htaccess file have the desired effect?
