Well if you are going to duplicate someones article they deserve the credit. I would recommend combining two or three article sand adding some personal value to it. Create something unique that your audience will like. Also linking to a reputable source shows Google that you are relevant to something. If you run an SEOmoz report card they recommend an external link to a relavent source.

One of my listings says it has been closed and the business is not closed. On Google + / Google places there is a field that allows users to check that claims the business is closed. Can they actually close it?

They are doing ok. But you can do better. I have always been up against some pretty challenging competitors. Don't only focus on what they are doing, spend more time focusing on what you can do to win. Take the good from what they are doing and do better. SEO is a challenge but as long as you dedicate time into being unique and valuable to the searchers the search engines will reward you:)

If you are going to rebuild the site on a new URL with the same content. You can copy the content externally (in word or another app) and de-indexed the bad site. Once the bad site is completely de-indexed from Google you can add the old content to the new URL and submit the new site map to Google.
Otherwise you can also start contacting webmasters to remove or change those backlink so that you are not over optimizing.

I disagree with no "SEO effort". I think "SEO effort" is the problem. People are still creating content for search engines, this is not how you earn rankings. The goal is to create content that is unique, educational, or entertaining. Set yourself apart from the competition. Earn your keep. Google wants to show the best possible results and they use users from which ever matrix they can gather to estimate who will rank.
My quote is "Give the people what they want and Google will give you to the people"
No SEO effort is not good however SEO effort the way people think of it (Spamming, taking whatever link you can get, buying links, cheap tactics) is wrong.
Create valuable content, target the right people and market your business.

New Panda Update - Over optimizing / Overstuffing keywords
Over optimizing is when a page on a site is using an exact keyword without variations on a page. For Example:
Title: "Chaussures grandes tailles"
Description: "Chaussures grandes tailles" bla bla bla
H1: "Chaussures grandes tailles"
Body: "Chaussures grandes tailles" 10 times 1 in bold, 1 underlined, and 1 in italic.
Overstuffing keywordsis when a page has 100 exact phrases "Chaussures grandes tailles" on a page with 10,000 words on it. This keeps the ratio low when comparing keywords to content.
Penguin Update
This was placed to prevent unnatural link building/spam
(When a user likes your page they will link to it. Naturally the link is going to be your Company name or Brand name.)
When a company links to a page on their site 100x with an exact keyword "Chaussures grandes tailles" without variation and without a brand name it looks unnatural. This can trigger the penguin update.
A natural link building structure should be:
70% Branding
20% Diverse Anchoring (big shoe, cool big shoe, amazing big shoe, best big shoe, etc...)
10% Exact

You must trackback(link back) to the original content. Otherwise Google looks at your content as duplicate. As as you give the original content credit you can avoid duplicate content.
However If you don't want this content to appear in your sites index but you do want it to appear on your site for your users do: noindex, follow -
Or you could use a rel=canonical tag and call out the original post as the canonical post.

majority of their keywords are branded (same as their URL)

Are these the two sites you are seeing? If not you may have personalized settings on.

Many factors are involved here I see that you have allot of links anchored "oxygen concentrators" and they are on pages that have a great amount of links. Not sure what your main keywords are, however your backling profile is raising red flags IMO. I would recommend building some quality links by creating unique articles on authoritative sites. Also the Penguin update is designed to find over optimization, your sites links look unnatural (they are). It is a good practice to have the site/brand name linking in more than the other anchors.
As far as your sites rankings go maybe the competitors sites were building worse links or Google has not detected the type of links you have.

Sounds like a case of the Google dance... It will balance out, unless you have some personalized settings on. If its a case of personalized settings try searching for your results with private browsing (firefox), or incognito window(google chrome). Myblogguest.com is a good place to get some free content for your blog. However you will need to give credit the writer with a link to their site.
Keep in mind content is only 1/3rd the battle. Getting that content to the right people/social networks is what will help you gain more visibility.

Avoiding the penguin slap in the face.
I work with a web design / SEO company and when we complete a site we want the credit for it, a link at the bottom of the page we build does suffice... Problem is this causes irrelevant linking / unnatural linking. If we "nofollow" these are we ducking the penguin? Are we better off not linking at all?

The report card should be corrected, there needs to be some 'if's' in there.

Question regarding the SEOmoz Report Card
A report card is directed towards one keyword. What if one is to target two keywords on one page?
For example, if I want to target SEO in Miami, Miami SEO, and SEO Miami it would be impossible to get an "A" on the report card for all three. What is the best way to target two-three keys on one page? Lets say these keywords are equally beneficial to the site, and we do not want to have to use hierarchy for one key over the other.
Would it be wise to build a page for each? I feel like that would be redundant to the user.
It says I need the keyword 4 times in the body so I should have 4 "SEO Miami" and 4 "Miami SEO".
High importance factors. What makes them high importance? The keyword should be in the beginning of the title. How does this make sense as a high importance factor. Many titles are going to sound spammy if this is how they are written.
Lets use Miami SEO again as an example:
Miami SEO from [company name] bla bla bla sounds like spam.
Learn about SEO in Miami from [company name] sound much better and is probably more likely to get clicked on.
How important are these High Importance factors?
I was always under the impression that we build the site for the user however the report card changes that perspective.

Simply trackback to the originals. As long as you trackback to the original content the search engines will know that this is not duplicate content.
If you are using Wordpress for your website simply click the "screen options" on top and check "send trackbacks." That will add the field.
I attached an example of the "screen options" tab with the "send trackbacks" selected.

What type of links should be followed and nofollowed internally?
We have submitted our sitemap.xml to search engines so now that they have that should we use a nofollow attribute on the sitemap.html? Do we even need a sitemap.html?
For other links on the site such as:

Locations

Meta tag keywords are not good for SEO anymore, Bing looks at this as a spam indicator. If the site you are looking at still has these tags on their site they are probably not up to date with the latest practices.... I wonder how good their phrases will be

"Likes" on a photo gallery
From my understanding its best to get likes on a website rather then from within the Facebook page for SEO purposes.
What is better to set up a photo gallery with a like button on each image so that every URL gets liked separately for each image or having a like button for the entire gallery.
10 likes on one page or 1 like on 10 pages?
