Site was moved, but still exists on the old server and is being outranked for it's own name

Recently, a client went through a split with a business partner, they both had websites on the same domain, but within their own sub directories.
There is a main landing page, which links to both sites, the landing page sits on the root.
Ie. example.com is a landing page with links to example.com/partner1, and example.com/partner2
Parter 2 will be my client for this example.
After the split, partner 2 downloaded his website, and put it up on his own server, but no longer has any kind of access to the old servers ftp, and partner 1 is refusing to cooperate in any way to have the site removed from the old server.
They did add a 301 redirect for the home page on the old server for partner 2, so,
example.com/partner2/index.html is 301'ing to the new site on the new server, HOWEVER, every other page is still live on that old server, and is outranking the new site in every instance.
The home page is also being outranked, even with the 301 redirect in place.
What are some steps I can take to rectify this?
The clients main concern is that this old website, containing the old partners name, is outranking him for his own name, and the name of his practice.
So far, here's what i've been thinking:
Since the site has poor on-page optimization, i'll start be cleaning all of that up.
I'll then optimize the home page to better depict the clients name and practice through proper usage of heading tags, titles, alt, etc, as well as the meta title and description.
The only other thing I can think of would be to start building some backlinks?
Any help/suggestions would be greatly appreciated!

Then send a DMCA to the server company. The server company doesn't care that he's a lawyer, and I bet your client and send a very well written one.
Besides that, you're strategy moving forward seems pretty sound.

Ironically enough.. they're both Lawyers.
Unfortunately, the old parter is refusing to cooperate at all as far as getting those pages 301'd or removing the site from the server completely.

First things first: before you start working on optimizing the new site, I would work on resolving the issue with the old partner, since this is an issue that can continue to haunt you for a long time if you don't.
The old partner needs to 301 redirect all pages in your client's subdirectory to the new site. Offer to send him the steps needed to do this. If he refuses, let him know that he does not own the data from your client's side of the old website, and you will therefor be forced to send DMCA takedown requests to the server company and to him for straight-up copyright infringement. Once he cooperates and puts in the proper 301s, you will have much less to worry about.
Unless, for some reason, the old partner does own the data, in which case, you shouldn't be using it on the new site.

Google Indexed Site A's Content On Site B, Site C etc
Hi All, I have an issue where the content (pages and images) of Site A (www.ericreynolds.photography) are showing up in Google under different domains Site B (www.fastphonerepair.com), Site C (www.quarryhillvet.com), Site D (www.spacasey.com). I believe this happened because I installed an SSL cert on Site A but didn't have the default SSL domain set on the server. You were able to access Site B and any page from Site A and it would pull up properly. I have since fixed that SSL issue and am now doing a 301 redirect from Sites B, C and D to Site A for anything https since Sites B, C, D are not using an SSL cert. My question is, how can I trigger google to re-index all of the sites to remove the wrong listings in the index. I have a screen shot attached so you can see the issue clearer. I have resubmitted my site map but I'm not seeing much of a change in the index for my site. Any help on what I could do would be great. Thanks

Open Site Explorer - Top Pages that don't exist / result of a hack(?)
Hi all, Last year, a website I monitor, got hacked, or infected with malware, I’m not sure which. The result that I got to see is 100’s of ‘not found’ entries in Google Search Console / Crawl Errors for non-existent pages relating to / variations of ‘Canada Goose’. And also, there's a couple of such links showing up in SERPs. Here’s an example of the page URLs: ourdomain.com/canadagoose.php ourdomain.com/replicacanadagoose.php I looked for advice on the webmaster forums, and was recommended to just keep marking them as ‘fixed’ in the console. Sooner or later they’ll disappear. Still, a year after, they appear. I’ve just signed up for a Moz trail and, in Open Site Explorer->Top Pages, the top 2-5 pages are relating to these non-existent pages: URLs that are the result of this ‘canada goose’ spam attack. The non-existent pages each have around 10 Linking Root Domains, with around 50 Inbound Links. My question is: Is there a more direct action I should take here? For example, informing Google of the offending domains with these backlinks. Any thoughts appreciated! Many thanks

Why is google automatically showing my competitor's result even when customer types in our brand name on the query?
This is little weird. We run a website specific to mobile phones called as 91mobiles.com. The site has gained lot of user interest and trust in the last 2 years [pre-dominantly indian users]. Lot of our users type mobile phone model and 91mobiles as the query. Example "Sony Xperia P 91mobiles". Google is showing gsmarena.com results on top and then shows our own results below! What's annoying is the fact that google also bolds the term gsmarena [denoting that it's a synonym]. Any idea why this is happening? We are very sure that we are not doing anything wrong..We have worked really hard for the last 2 years to reach where we are..and it's kind of hard to see gsmarena siphoning away our traffic for no reason at all [even when customer types in 91mobiles a part of the query to quality it]...Can some experts here demystify this? Thanks.

How to handle a server outage if I have two sites
I operate a web application. It consists of two sites, www.mysite.com and app.mysite.com. As you might imagine, www is used for marketing purposes, and it's our main organic search entry point. The app.mysite.com domain is where our application portal is for customers, and it is also where our login and registration pages are located. Currently, www.mysite.com is experiencing a catastrophic outage and is returning 504 errors, but app.mysite.com is on a totally separate system with a lot redundancy, and is doing just fine. If we get traffic from referrals or search, we want that traffic to be able to login and register, so we've replaced the 504 error with a 302 redirect to app.mysite.com until the situation is resolved. This provides the best possible experience for users (nothing's worse than a 504). How will this affect SEO? Is there something other than a 302 that I should be doing with the broken www.mysite.com domain?

Old Redirecting Website Still Showing In SERPs
I have a client, a plumber, who bought another plumbing company (and that company's domain) at one point. This other company was very old and has a lot of name recognition so they created a dedicated page to this other company within their main website, and redirected the other company's old domain to that page. This has worked fine, in that this page on the main site is now #1 when you search for the other old company's name. But for some reason the old domain comes up #2 (despite the fact that it's redirecting). Now, I could understand if the redirect had only been set up recently, but I'm reasonably sure this happened about a year ago. Could it be due to the fact that there are many sites out there still linking to that old domain? Thanks in advance!

Is 404'ing a page enough to remove it from Google's index?
We set some pages to 404 status about 7 months ago, but they are still showing in Google's index (as 404's). Is there anything else I need to do to remove these?
