There is a copy of our website that is ranking. How can I let Google know our website is the authentic site?

I just found another copy of my old website and have no way to take it down. Unfortunately, it's ranking so he didn't place it as a nofollow. (My boss hired someone to redevelop our website before I came on board and never finished the project).
So, could this be hurting us? I tried to look to see if we were being penalized and couldn't find that we were.
Also, ever since we migrated to a new domain name, our ranking is tumbling. I've redirected properly and tested to make sure they're resolving correctly and they are. I have no idea what is going on. We've virtually lost all ranking. Any help would be much appreciated.

The technical term is a Digital Millennium Copyright Act. There's a bit more info on this page to get you started: https://support.google.com/legal/answer/1120734. It's been a while since I've filed one of these but let me know if you run into trouble I'm happy to help.
Also, I'd only use this as a last option. I'd still reach out to the company and see if they will no index the other site.

Jordan, thank you so much for the insight. I'm going to go through each step you presented. Which channel would you recommend contacting Google through if the owner of that domain isn't willing to cooperate? Thanks again for your help.

Sorry to hear you have to come on board and clean up someone else's mess :/.
The first thing I would do is reach out to the development company and request they remove the extra site. It's very likely it's having an impact on your organic visibility. If that doesn't work you could request Google remove that website from its index based on a violation of intellectual copyright laws.
The second thing I would do is a detailed audit of all your redirects. It's likely there could be a few key missing redirects in there somewhere.
Request a copy of all redirects within your Htaccess file and make sure: they are topically relevant(think 1:1 matches no blanket redirects), and no redirect chains present.
Also, go into your GA and pull the top 100 or so pages with any sort of historical organic traffic and make sure they are redirecting properly.
Another thing which I'm sure you're aware of but whenever you migrate domain names there can sometimes be an initial drop in organic rankings.

Google rankings
I have encountered a serious problem with google rankings and the sequence of events goes like this for a high volume phrase. I make changes to the page which gets a score of 98 in Moz and equally good scores in other tools. I resubmit the page to Google for searching via crawl in google webmasters. After about 1/2 to 1 day, the page will be ranked between 30 and 50. Within another 1/2 to 1 day, the ranking goes completely away. This page has much higher scores than pages that are ranked. Other phrases continue to rank OK.

Word Count - Content site vs ecommerce site
Hi there, what are your thoughts on word count for a content site vs. an ecommerce site. A lot of content sites have no problem pushing out 500+ words per page, which for me is a decent amount to help you get traction. However on ecommerce sites, a lot of the time the product description only needs to be sub-100 words and the total word count on the page comes in at under 300 words, a lot of that could be considered duplicate. So what are your views? Do ecommerce sites still need to have a high word count on the product description page to rank better?

Can Rankings in Google differ so much from computer to computer.
I was telling my friend via facebook to go on my website, I told him to search 'nightlife forum' in google. To which, I believed it was 11th, top of second page. On his computer, its currently ranking at 1st place is it possible to have a difference of 10 places? even though he lives in the same city as me. Would be good to see what it ranks on your computers too google "nightlife forum" look for www.talknightlife.co.uk (don't get confused with the .COM one out there) Cheers Guys

Remove internal site SERPS from Google Index?
1. Internal Serp pages did not have a robots meta tag 2. As a result, client site has thousands (~4,400) of internal site SERP pages in the Google index. 3. We added the NoIndex, Follow attribute to all internal SERPS 4. We Disallowed: domain.com/internal-search-operator in Robots.txt 5. No new SERP pages are being indexed, but the other 4000 something that were already there are still in the index weeks later. 6. The pages are dynamically created and still work, so I can't use the Remove Content tool from google, because the pages don't 404. Is there any way to get these pages out of the index besides just waiting and hoping google eventuall drops them? Thanks
